www.bacci-paris.com (the “Website”) is edited by DE GERAULT identified as SIREN 909 863 417 and SIRET 909 863 417 00012, whose registered office is 10 rue George Bernard Shaw - 75015 Paris (hereinafter “Bacci Paris”). 


I- Application of the general terms and conditions of sale

 

These general terms and conditions of sale (hereinafter the "GTC") apply to the Bacci Paris online store website accessible at www.bacci-paris.com (hereinafter the "Website") and to orders (hereinafter the "Order") placed on the Website.

 

The Web Site is reserved for retail sales to individuals acting for personal purposes (the "Customer"). The Customer represents and warrants that it is acting as a final consumer of the products it orders.

 

The terms and conditions of sale (the "T&Cs") detailed below apply to and are an integral part of all orders and sales of products placed via the Website (the "Products") with Bacci Paris by the Customer. 

 

Please read these Terms and Conditions carefully before using the Website and placing an order on the Website.

 

The sales contract is subject to French law.

 

II- Products

 

The Products offered for sale on the Website are valid while stocks last.


Bacci Paris does not guarantee the accuracy or security of information transmitted or obtained through the Site. Thus, the photographs, graphics and descriptions of the products offered for sale are only indicative and do not engage the responsibility of Bacci Paris. In particular, the photographs illustrating the Products may differ slightly from reality due to the Customer's screen settings or the lighting during the shooting. 


It is possible that the Customer may receive a product following an Order that was previously returned by another person. It is specified that Bacci Paris only accepts the return of undamaged and unworn Products, these two conditions being checked before the returned Products are put back into stock.


III- Order


Orders placed on the Site are subject to compliance with the procedure set up by Bacci Paris on the Site, which includes successive steps leading to the validation of the Order.


The Customer may select as many Products as he/she wishes. These Products will be added to the shopping cart (the "Shopping Cart"), which summarizes the Products selected by the Customer as well as the prices and fees associated with them. The Customer may freely modify the Shopping Cart before validating the Order. 


Bacci Paris will send the Customer a confirmation email summarizing the Order. To this end, the Customer formally accepts the use of electronic mail for Bacci Paris to confirm the contents of his/her Order.


The Order constitutes acceptance of the proposed price. Once the Order is confirmed, the Customer agrees to be bound by a sales contract, subject to the availability of the Products and the validation of the payment.

 

Bacci Paris reserves the right to be temporarily or permanently out of stock and not to be able to deliver a Product in this eventuality.

 

In the event that a Product ordered is unavailable, for reasons beyond Bacci Paris' control, the Customer will be informed by email. In this case, the Order will be automatically cancelled and refunded. Bacci Paris may offer the Customer a replacement Product of equivalent quality and price.

 

In the event of a cancellation confirmed by the Customer, Bacci Paris will take all necessary steps to reimburse the Customer for the amount already paid, within thirty (30) days at the latest from the date the Customer is informed of the choice made. No compensation can be claimed in the event of an order cancellation.

 

Bacci Paris takes the greatest care in the presentation and description of these products in order to provide the Customer with the best possible information. It is however possible that non-substantial errors may appear on the Website, which the Customer acknowledges and accepts.

  

Any order follow-up will be done exclusively by email. Bacci Paris will confirm to the Customer, by writing to the e-mail address that the Customer will have provided, that his/her request has been accepted. All sales will only be concluded once Bacci Paris has confirmed the order to the Customer.

 

In principle, the order is processed as soon as possible (except in cases of force majeure). The Customer will receive confirmation of the information specific to the accepted order within ten (10) working days at the latest of Bacci Paris' receipt of the order. 

 

Bacci Paris reserves the right not to accept a Customer's Order - for example, if there is a dispute over the payment of a previous order - and will inform the Customer of this within ten (10) working days of receiving the Order.

 

The information provided by the Customer at the time the order is placed is binding upon the Customer. Should the Customer provide false information concerning the recipient, Bacci Paris shall in no way be held responsible for the impossibility of delivering the Product(s).

 

IV- Prices and payment methods


The prices are invoiced in Euro on the basis of the tariffs in force at the time of the order, subject to possible errors of seizure or modification of the VAT rate.

 

The offers are valid within the limits of available stocks.

 

The prices displayed on the Bacci website include the French VAT of 20%.

 

Furthermore, Bacci Paris reserves the right to update the prices indicated at any time and without prior notice.

 

It is the Customer's responsibility to verify the final price of the desired products before ordering.

 

For all deliveries outside metropolitan France, any customs fees and local taxes are the responsibility of the recipient.

 

Payment for purchases is made via Sopify payments. The data recorded and kept by Bacci Paris constitutes proof of the Order and of all transactions made. The data recorded by Shopify Payments constitutes proof of the financial transactions.

 

The prices of the products are indicated on the Site in euros for Europe, in pounds sterling for Great Britain and in US dollars for the United States, including VAT, but excluding customs fees and other taxes. Customs duties and other taxes must be paid by the Customer directly to the carrier.


All prices displayed are calculated and include the value added tax (VAT) applicable in France or in the country of delivery located in the European Union.

 

V- Delivery

 

The delivery means the transfer to the Customer of the physical possession of the Products (the "Delivery").


The deliveries are ensured by the services of the French Post office from Monday to Friday.


The Delivery takes place by the reception of the Products at the indicated postal address, being specified that this one must be the address of residence of the Customer, of a physical person of his choice or of a moral person (delivery to his company). 


Orders are processed within 24 to 48 hours.

The standard shipping times for countries covered by our delivery partners are shown below.

- In France: 2-3 days

- In Europe: 1 week

- Rest of the world : 7-13 days

The delivery times indicated are in working days. 


In order for these deadlines to be respected, the customer must ensure that he/she has provided accurate and complete information concerning the delivery address (such as, in particular: street number, building, staircase, access codes, names and/or intercom numbers, etc.).

 

The times indicated are indicative times, corresponding to the average processing and delivery times. Bacci Paris cannot be held responsible for the consequences of a delay in delivery that is not its fault.

 

In the event of an abnormally long delivery time or non-receipt of the Products ordered, the Customer may contact customer service by e-mail at contact@bacci-paris.com. An investigation will then be opened with the carrier to locate your package. The duration of this investigation can vary from 2 weeks to 1 month, depending on the period.

 

If the parcel is found, it will be immediately sent back to you at the address indicated at the time of the order.

 

If the package is declared lost by the Post Office, the products will be reshipped (within the limits of available stocks) or refunded. No refund or return of products can be made before the investigation is completed.

 

VI- Shipping costs

 

Shipping costs are covered by Bacci Paris.

 

VII- Exchanges, refunds and returns

 

Pursuant to Articles L.121-20 et seq. of the French Consumer Code, the Customer may request a refund or exchange within fourteen (14) days of receiving his/her order.

 

The product(s) must be returned in its original packaging, in its original, new, unworn condition, to the following address LEDL, 5 rue Léon Lhermitte, 75015 Paris, FRANCE.

 

The returns of the product(s) are at the buyer's expense.

Any reservations regarding the condition of the products (e.g. open or damaged package) must be notified immediately upon delivery.

 

VIII- Intellectual and industrial property

 

All illustrations, images, fonts, presentation methods, graphics and fonts on the Website are and remain the exclusive property of Bacci Paris or of the holders of the said rights who have granted Bacci Paris a right of exploitation. Any reproduction, representation or use of the said rights by a Customer will constitute a fault giving rise to legal proceedings.


IX- Data Confidentiality

 

Bacci Paris treats all information concerning you with the utmost confidentiality. In accordance with the French Data Protection Act of January 6, 1978, you have the right to access and rectify your personal data.


The Customer is likely to receive offers from Bacci Paris concerning products similar to those already ordered, or newsletters. The Customer may at any time object to such offers or newsletters in accordance with the terms and conditions specified in each mailing.

 

X- Litigation

 

Bacci Paris shall not be held responsible for the non-performance of the contract in the event of force majeure, and in particular, in the event of natural disaster, war, strike, flood, fire, etc.


In case of dispute relating to the interpretation or execution of the contract, the French jurisdiction will be the only one competent.

 

XI - Applicable law - Jurisdiction

 

The sale of Products is subject to French law. 


In the event of a dispute arising from an Order or sale, the Customer may submit a written complaint to the Customer Service Department at contact@bacci-paris.com. 

 

Any dispute shall be submitted exclusively to the competent courts within the jurisdiction of the Paris Court of Appeal, or, if the Customer is a consumer, to any legally competent court.
